Introduction. 

(a) Site Owner. Hammy’s Food Joint (the “Company“, “We”, “Us”, “Our”, etc.) is the owner of Hammysfood.com (the “Site“). We can be contacted by mail at [117 S Lexington Street STE 100 Harrisonville, MO 64701], by phone at [314-230-2193], or by e-mail at hammysfoodstl@gmail.com. This online privacy notice discloses the Company’s information practices for this Site, including what type of personal identifiable information is requested in order to make a purchase, how the information is used, and with whom the information is shared. 

(b) Site Visits. In general, you can visit our Site without revealing any personal information. 

(c) Site Transactions. At times, we may collect personal and financial information regarding a customer or a prospect. It is our intent to inform you now before we collect personal information, such as your name and/or address. If you tell us that you do not wish to have this information used as a basis for further contact with you, please reach out to the email listed in Section 1(a), and we will respect your wishes.

  1. Personal Information That May Be Collected.

(a) Identifying Information. In order to make a purchase, we will ask you to provide certain personal identifying information, which may include: your name, address, e-mail address, screen name, password, telephone number, method of payment, and, if applicable, credit card number. We may ask for additional information to establish and maintain your customer account.

(b) Information from Children. The Company does not sell to children and will not collect or post information from a child under the age of 16 without a parent’s or guardian’s involvement. If you believe your child under the age of 13 has provided information to us, please reach out to us at the e-mail address provided in Section 1(a) to remove the information from our system. 

(c) Lost or Stolen Information. If a customer’s card information [and/or password] is lost or stolen, you must promptly notify us so we can cancel the lost or stolen information and update our records with different card information [and/or password].

(d) Links to Other Sites. Our Site may contain links to other websites. We are not responsible for the privacy practices or the content of those other Sites.

  1. Uses of Information.

(a) Limited Uses Identified. We will not use your personal identifiable information for any purpose other than why it is submitted without your prior consent. We use personal identifiable information to fulfill requests and online orders, provide customer services, reply to inquiries, handle complaints, make improvements to the Site, and provide operational notices and in program record-keeping.

 

(b) Marketing Uses. The information you provide on our Site may also be collected, used, analyzed and/or processed by us or selected third parties on our behalf, for marketing and other business purposes. Before we use the information, we will notify you and offer you the opportunity to opt-out if you do not want your personal identifying information used in this way.

(c) Stored Information Uses. We store and retain the information entered on our Site. Stored information is used by us to support customer interaction with our Site, deliver customer purchases, and/or continue a dialogue regarding our services and products.

(d) Online Advertising. Some companies that help us deliver interactive on-line advertising, such as banner ads, may collect and use information about our customers to help us better understand the types of advertising or promotions that are most appealing to our customers. After it is collected, the information is aggregated so it is not identifiable to a specific individual. If, however, you would prefer that these companies not collect such information, please mark an “x” on the opt-out option box provided.

  1. Disclosure of the Information.

(a) Agents. We work with other companies and individuals to perform business functions on behalf of the Company. These persons are provided with personal identifying information required to perform their functions but are prohibited by contract from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments, and providing customer services.

(b) Marketing Analysis by Third Parties. We reserve the right to disclose customers’ personal information to third parties for marketing analysis. However, any information disclosed will be in the form of aggregate data that does not describe or identify you or any individual customer.

(c) Sale of Information. We never share, sell, or rent your personal information without prior notice to you and the opportunity to opt-out.

(d) Disclosure to Governmental Authorities. Under certain circumstances, we may release your personal information pursuant to regulation, a judicial or other government subpoena, warrant, or order, or other mandatory disclosure rules, as required by law.

(e) Required Security Disclosures. We may need to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms and Conditions of Use, and as specified in this Privacy Policy or as otherwise required by law.

  1. Use of Computer Tracking Technologies.

(a) No Tracking of Personal Information. Our Site is not set up to track, collect or distribute personal information not entered by visitors. Through Site access logs, we collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes such as user analysis and business decision making, which provides better services to the Company’s customers. These statistics, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.

(b) Use of Cookies. The Company collects non-identifiable and personal information through the use of various technologies, including “cookies”. A cookie is an alphanumeric identifier that a Site can transfer to a customer’s hard drive through the customer’s browser. The cookie is then stored on the customer’s computer as an anonymous tag that identifies the customer’s computer, but not the customer. We may send such cookies. You can set your browser to notify you before a cookie is received, giving you an opportunity to decide whether to accept the cookie. You may also set your browser to turn off cookies; however, some websites, including our Site, may not then work properly.

(c) Collection of Non-Identifiable Information. We may collect non-identifiable information from user visits to the Site in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the Site; Site and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” We may use this data to analyze trends and statistics.

(d) Collection of Personal Information. We collect your personal identifying information during a transaction. We may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help the Company understand trends and patterns. This information is not reviewed at an individual level.

  1. Information Security.

(a) Commitment to Online Security. The Company employs physical, electronic, and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints. 

(b) No Liability for Acts of Third Parties. We will exercise all reasonable efforts to safeguard the confidentiality of your personal information. However, transmissions protected by industry standard security technology and implemented by human beings are not and cannot be made absolutely secure. Consequently, we shall not be liable for unauthorized disclosure of personal information due to no fault of the Company, including, but not limited to, errors in transmission and unauthorized acts of the Company’s staff and or third parties. Further, it is your responsibility to make sure your password and account information are kept safe and secure.

  1. Privacy Policy Changes and Opt-Out Rights.

(a) Changes to Privacy Policy. We reserve the right to change its privacy policy at any time. Notice of such change will be posted on our Site page for thirty (30) days prior to the implementation of such change. If you do not mark the “I do not accept” box, you will be deemed to have accepted our privacy policy updates.]

(b) Opt-Out Right. You have the right at any time to cease permitting personal information to be collected, used or disclosed by us and/or by any third parties with whom we have shared and/or transferred such personal information. You have a right of cancellation you may exercise by contacting us at the contact information listed in Section 1(a). After processing the cancellation, we will delete your personal information from our database.

  1. Access Rights to Data.

(a) Information Maintained by Us. Upon customer’s request, we will provide a reasonable description of customer’s personally identifiable information that we maintain in our data bank. contacting us at the contact information listed in Section 1(a).

(b) Corrections and Changes to Personal Information. Help us keep your personal information accurate. If your personal information changes, or if you note an error upon review of your information that we have on file, please promptly contact us at the e-mail address listed in Section 1(a) and provide the new or correct information.

(c) Your California Privacy Rights. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of the Company who are California residents to request certain information regarding our disclosure of personal information for our direct marketing purposes. To make such a request, please reach out to us at the contact information listed under Section 1(a). Within 30 days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve the right not to respond to requests submitted other than to the address specified in this policy statement.

California’s privacy laws require a company to provide notice to California users of their rights to receive information on to which entities their information was shared for marketing purposes.

  1. Applicants for Employment.

(a) Information Collected. If you apply for employment with us, we may collect certain personally identifiable information, including your name, address, phone number, email address, employment history, educational background, and more. We may also obtain data and other personally identifiable information from references provided by you.

(b) Use of Third-Party Sites. We may collect user data related to an application for employment if you apply for employment with us through third party sites, service providers, recruiters, or employment agencies.

(c) Retention and Disposal of Data.  We will retain your personally identifiable information for thirty (30) days after a decision is made with respect to your employment. After such time, we will dispose of your personally identifiable information. We will not attempt to re-identify any personally identifiable information you provide in an application for employment with us.

(b) Terms of Use. If you purchase a product or service through the Site, such action is deemed acceptance of the practices described in this privacy policy.
